PSOL and environmentalists will go to the Supreme Court to protest the overturning of vetoes on the Deforestation Bill.

The PSOL party, along with several environmental entities and organizations, such as the Climate Observatory and the ISA (Socio-environmental Institute), will file a Direct Action of Unconstitutionality (ADI) with the Supreme Federal Court (STF) against the overturning of the Lula government's vetoes on the Deforestation Bill, which dismantles environmental licensing in Brazil.

Environmental experts believe that overturning the vetoes introduces unconstitutional elements to the new law. One of the setbacks, for example, is the provision that environmental impact assessments be conducted only in directly affected territories, without considering indirectly affected areas and areas of influence, in addition to disregarding the cumulative effects of damage.

Under the new law, the environmental licensing of the Brumadinho dam (MG), for example, which was considered medium-sized, would be done through a License by Adhesion and Commitment, a self-declaratory licensing process. In these cases, the company responsible for the work only declares that the project is in compliance with the rules of the environmental authorities, without any analysis being carried out by the control bodies.

Congress also reinstated a section of the bill that exempts road maintenance and improvement projects from environmental licensing requirements.

The lawmakers also reinstated the exemption from licensing for rural activities that take place on properties undergoing the approval process in the Rural Environmental Registry (CAR).

Other points reinstated by Congress restrict consultation with indigenous peoples and quilombola communities in the licensing process.

According to the text, only officially recognized indigenous lands and titled quilombola territories will be able to express their opinions.

Members of the Chamber of Deputies and the Senate also approved a reduction in the number of cases to protect against deforestation of primary and secondary forests in the Atlantic Forest.
